"Beyond Rhetoric"

December 7, 1991

Dear Fellow Republican Citizens of New Hampshire:

I am seeking the Republican Party nomination for President of the United States in our 1992 Primary Election. We must send a message, loud and clear to Washington, that we do not condone the actions of our government officials in the Executive, Legislative or Judicial Branches; that we in this State measure a man or organization by their Actions, not their Rhetoric of promises; that ethical behavior, honesty and courage of conviction is needed by our elected representatives at every level; and that New Hampshire will lead the way in correcting the problem.

We all recognize that we are responsible for our National problem ... greed ... that somehow the acquisition of money or property will bring us individual happiness and there is little need for hard work or sacrifice. "No Sweat!" Why do I have to know math when I have a functioning calculator? Why do I have to know English or History or Respect or Morals or Duty or Honor? We reward and laugh at bad grammar, disrespect, bad morals and dishonesty. What examples are parents and elected leadership giving our children? Are our values being replaced by television sit-coms or news reports, where our government officials spoon-feed us twisted and distorted views while continuing to pursue their hidden agenda of self-enrichment? Senator Cranston's answer to the Senate for taking $900,000.00 was, ''my behavior did not violate established norms."

Our New Hampshire roots are deep into Bunker Hill and Valley Forge, and the fight for liberty ... "Live Free or Die," became our State slogan, but are we really free? Our ancestors fought for the freedom to raise their children, without government edicts on individual rights which serves to destroy families; the right to earn a decent wage or start a business, without being over regulated or overcharged; the right to be equal female/male, black/white, rich/poor; the presumption of innocence until proven guilty; and the right to increase one's capabilities or qualifications. We want to be secure in our homes and property, without a police state.

To the Editor:

– A STATE RELIGION –

Anyone old enough to remember, "The $64,000.00 Question" TV show, must remember the drama in spelling 'antidisestablishmentarianisn' for a winning question. Establishmentarianism is a religion that is either the State or the only religion supported by the State. Add prefix 'dis' and it's dismantling a State religion, but by adding 'anti' we are against the dismantling of a State religion.

A 'religion' does not necessarily imply the doctrine of a personal God or any kind of God in it. Religion, came from the Latin word, 'Relegere, to "bind" or collect together. Thus, when group of people pursue a common idea and one belief in something, that belief is a religion.

The American Bar Association and the whole Judicial/Legal Monopoly are antidisestablishmentarian since they created the secular religion in the United States called Juris Prudence -The science of law which has for its function to ascertain the principles on which legal rules are based, but today ignored unless convenient for the legal profession. It was to facilitate the interaction of individuals. Today it's the bramble bush that inhibits interaction. Rules of society were easily read and understood. Now, everything is complicated and cumbersome,

Today, $64,000.00 is not a great deal of money since million dollar lotteries. We need a lawyer in almost all aspects of our lives that was not intended by our Founding Fathers. (Read an Anti Federalist fear, "The Address and Reasons of Dissent of the Minority of the Convention of Pennsylvania to Their Constituents – December 18, 1787."
 
The judicial powers vested in Congress are also so various and extensive that by legal ingenuity they may be extended to every case, and thus absorb the state judiciaries, and when we consider the decisive influence that a general judiciary would have over the civil polity of the several states, we do not hesitate to pronounce that this power, unaided by the legislative, would effect a consolidation of the states under one government.

"The powers of a court of equity, vested by this constitution, in the tribunals of Congress; powers which do not exist in Pennsylvania, unless so far as they can be incorporated with jury trial, would, in this state, greatly contribute to this event. The rich and wealthy suitors would eagerly lay hold of the infinite mazes, perplexities and delays, which a court of chancery, with the appellate powers of the supreme court in fact as well as law would furnish him with, and thus the poor man being plunged in the bottomless pit of legal discussion, would drop his demand in despair."

The Court Scheme has become a secular religion. Judges/Lawyers have a system that binds them together. They also have a hierarchy, titles, robes of office, exclusive ceremonies, secret meetings, under­standings and rulings. The goal is financial gain for the Bar Association's Members. Honorable, Esquire, are titles of nobility – Sec., Page 8, "No title of nobility shall be granted by the United States."
Today, money buys court decision ... The only average, absolute, citizen's right is to hire an attorney.

Since lawyers by Supreme Court decree are members of the Court, they should be ineligible to become members of the Legislature or Executive Branch under the 'separations of powers principle' in order to provide for checks and balances.

The fear of our Founding Fathers, under one government, is here today ... the Courts, under "color of the law" control the population, not the Legislature as a State Secular Religion. We must rise up and unchain the bonds that restrict us by implementing two rules:

1. Vote "NO" to any lawyer for public office.
2. Vote for a restriction of two terms for any public official.

Born May 19, 1942 ... educated and raised in Berlin, New Hampshire. I graduated from St. Anselm's College with a B.A. in History in 1965, while working at night for St. Johnsburg Trucking Company in Manchester, NH. That same year I enlisted in the U. S. Army in order to serve my Country during the Vietnam War, following in the footsteps of my three brothers who had enlisted during earlier wars. Entering the Army as an enlisted man, I qualified and graduated from Artillery Officer Candidate School, Ft. Still, Oklahoma, with the rank of 2nd lieutenant, in June, 1966. Following Communications School and Airborne Training, I was assigned to the 2nd Infantry Division on the hostile DMZ in Korea, November, 1966. My duty position was S-3
(Operational Officer) for a 155/8' Heavy Field Artillery Nuclear capable Battalion that was in the chain of command for tactical nuclear weapon use by the President. I held a Top Secret Clearance. This position was normally assigned to a Major. Our units came under fire and we responded to the North Korean aggression. It was a time of hostility just prior to the capture of the USS Pueblo. This was not reported in the United States because of the Vietnam War. I was decorated by the U. S. Army for my efforts.

My final tour, because of my security clearance and experience was as a Plans Officer in the 22nd FASCOM at Ft Lee, VA. While holding this high security position, I wrote contingency plans for the world wide support of U. S. Emergency Forces under CINC/STRIKE. My unit was deployed for civilian unrest when martial law was in effect in Washington, DC during the Martin Luther King riots of 1968. Again, I received a certificate of Achievement for my work in CINC/STRIKE and for protecting the Nation's Capitol from tyranny.

Following an honorable discharge from the Army in 1968, I began my business career with Kerr Glass Manufacturing Corporation as a sales representative in East Orange, New Jersey I was promoted in 1969 to a more responsible sales position in Philadelphia. In 1975, I became Assistant District Manager in Milwaukee with responsibility for $11,000,000. in direct sales to Miller, Schlitz, and Pabst Brewing Companies. In 1977, I joined Foster-Forbes Glass Company, a Division of National Can Company, as Regional Manager. Responsibilities included supervising and training salesmen and office personnel with a territorial budget of over $21,000,000. In 197 8, I joined Crown Cork and Seal Co., Inc., as the National Product Manager for Crowns and Closures, with United States sales totaling $40,000,000. The position required direct contact with all parent company soft drink companies, along with every brewery in the United States for marketing and sales. Later my responsibilities for Crown Cork and Seal included organizing presentations for as well as participation in industry trade shows such as the Master Brewers Association and National Soft Drink Conventions. With my wide exposure, I represented Crown Cork & Seal Co., lnc. in the legislative affairs at Can Manufacturers Institute in Washington, DC, dealing with all aspects of deposit legislation, government affairs, and lobbying. I was asked to investigate the possibilities of Crown Cork & Seal Co., Inc. starting its own recycling program.

As a result, I researched, interviewed, and worked with the major steel and aluminum companies and wrote a major study on the feasibility and methodology of recycling plastics, glass, bi-metal and aluminum cans. Many of these concepts were implemented when forming my own company, Packaging Recovery Systems, Inc. in October, 1980.

Packaging Recovery Systems, Inc., P. 0. Box 460, Fairview Village, PA 19409, has been primarily involved in recycling rigid packaging containers (can, glass and plastic containers), selling solid waste handling equipment and consulting in these industries primarily in New York,
New Jersey and Pennsylvania. This business was booming in October, 1987, with the crises in solid waste, especially in Greater New York City.

During simple divorce proceedings initiated October 20, 1987, my estranged wife's politically connected law firm in Montgomery County, Pennsylvania secured an injunction which diverted all income from my business into an escrow account controlled by the attorneys. This in junction violated Pennsylvania Rules of Civil Procedures which requires that a bond be posted and that a full adversarial hearing be held within five (5) days. Even after requests were made to dissolve the injunction, the business continued to be held ransom by the Judge for the benefit of the attorneys ... extortion by the legal scheme in this wealthy and prestigious area where all proceedings are elongated and complicated to boost legal fees.

I finally agreed to the extortion demands in December, 1987, in order to lift the injunction, but it was too late ... the business folded with losses in excess of $800,000.00 bankrupting me personally and my new business. Because of these irregular court proceedings, I moved back to Berlin, NH in December, 1987.

Following four years of litigation, charges have been filed against the Pennsylvania Courts for fraud, conspiracy and abuse of office against the Lawyers and Judges involved in these proceedings. Filings for Judicial and Attorney Discipline have been ignored. Petitions for Impeachment of these Judges have been filed and are currently under consideration by the Pennsylvania House Judiciary Committee. A public official has never been impeached in Pennsylvania.

The legal industry is a billion dollar industry whereas any attack on the Judiciary is met with retribution. As a result, I have had to proceed in these proceedings acting as my own attorney, having to learn the process for no other reason other than necessity ... venturing into areas of law and the legislature untraveled by other litigants in the Federal or State Legal System, especially in regard to Impeachment of State Judges.

As a result of these proceedings, four ( 4) Federal Law Suits have been filed, three of which are still active. One Writ of Certiorari to the U.S. Supreme Court has been filed with another to be filed shortly. Two Petitions have proceeded to the Supreme Court of Pennsylvania following seven appeals to the Superior Court and hundreds of required filings in the Trial Court.

The expensive lesson learned by me in my four (4) years of court battles against State and County officials/agencies is that the Courts do not serve to protect the interests of the people, but protect only the interests of the legal community.
"Judges protecting the lawyers to perpetuate the Scheme for the money," is the game.

Our only solution is to bring ethical behavior and accountability back to government We, the people, must assert our rights of government FOR THE PEOPLE, OF THE PEOPLE AND BY THE PEOPLE. For a start, we should enact two rules:

 
1.    Vote NO to any lawyer seeking political office;
2.    Vote to REDUCE all public offices to two terms.

Currently I represent several foreign corporations in the packaging industry, while in the process of working to rebuild my plastic recycling business destroyed by the courts. As a result of my experiences in the Courts, I have been active in forming and participating in judicial reform groups for the express purpose of holding public officials accountable for their actions.
