Calling to mind the Bush v. Gore drama that unfolded 18 years ago, Florida is once again the setting of a recount battle.  Actually there were three statewide recounts, but the U.S. Senate race drew the most attention.  While there were no hanging chads, the tense atmosphere was again present, complete with litigation and heated rhetoric.  "No rag tag group of liberal activists or lawyers from D.C. will be allowed to steal this election from the voters in the state of Florida," Scott declared.  Meanwhile Nelson asserted, "We believe when every legal ballot is counted we’ll win this election.” 

A critical difference between this recount and the one in 2000 was that, in contrast to the uncertainty in 2000, the outcome of this one was al but assured.  The odds that Nelson would emerge as the winner were infinitesimal to non-existent from the start.  An analysis of statewide recounts by FairVote found that "recounts only see a shift of a few hundred votes."  FairVote notes that, "Recounts are important tools that are crucial to maintaining the integrity of elections, but they are not do-overs."

Recount Update: Day 6

Morning all,

Late last night the Scott for Florida legal team notched a couple more big wins. Judge Walker denied the Democrats’ motion for an injunction in their case challenging the state’s voter intent standards.
Judge Walker also dismissed a lawsuit brought by the League of Women Voters and other liberal groups.

As CNN’s Ryan Nobles put it, “the path to victory for Bill Nelson is quickly narrowing.” Playing whack-a-mole in court to knock down lawsuit after lawsuit (I think the Dems are up to 9 now) certainly isn’t how we had hoped to be spending the week after election day. But you have to ask yourself, is playing a mole getting whacked in court really how Bill Nelson wanted to spend the week after election day?

After the 3pm deadline passed yesterday and our campaign actually INCREASED our margin over Bill Nelson, Senator-elect Scott released the following statement:

Senator-elect Rick Scott said, “Last week, Florida voters elected me as their next U.S. Senator and now the ballots have been counted twice. I am incredibly proud and humbled by the opportunity to serve Florida in Washington. Our state needs to move forward. We need to put this election behind us, and it is time for Bill Nelson to respect the will of the voters and graciously bring this process to an end rather than proceed with yet another count of the votes – which will yield the same result, and bring more embarrassment to the state that we both love and have served.”

With so much going on yesterday, it seemed like the biggest story of the day got lost in the shuffle, a bit.

The Naples Daily News’ Ana Ceballos broke a bombshell story outlining how the Florida Democratic Party knowingly shared altered election documents urging voters to cure their absentee ballots by 5pm on the Thursday after election day. The deadline in state law to cure absentee ballots in 5pm on the day before election day.

But it gets worse. According to activists in the know, they did this purposefully in hopes that a judge would rule to eventually include ballots cured after election day.

One Palm Beach Democratic activist said in an interview the idea was to have voters fix and submit as many absentee ballots as possible with the altered forms in hopes of later including them in vote totals if a judge ruled such ballots were allowed.

It’s hard to look at this as anything other than a coordinated effort by the Florida Democratic Party and the Nelson Campaign to fraudulently mislead voters to submit invalid affidavits and then argue in court that absentee ballots cured late should count.

Yesterday, in response to this story, Scott for Florida Campaign Manager Jackie Schutz Zeckman called on Bill Nelson to immediately demand the resignation of the Florida Democratic Party Chair.

Update: 60 Of 67 Counties Have Now Reported Results

60 of 67 counties have now completed the machine recount and reported results.

With almost 75% of votes recounted, Rick Scott’s lead has now GROWN by 54 votes.

Recount Update: Day 5

As we expected, the judge made a very limited decision this morning. We have already filed an appeal. See our statement here:


One note of clarification based on early reports. Judge Walker’s ruling is EXTREMELY narrow. He says that Supervisors of Elections are “required to allow voters who have been belatedly notified they have submitted a mismatched-signature ballot to cure their ballots by November 17, 2018, at 5:00 p.m.”

The important word here is belatedly. This is a tiny subsection of the approximately 5,000 signature mismatched ballots. Put simpler, this is a very small number of ballots.

A couple notes on yesterday’s hearing in Bill Nelson’s suit regarding mismatched signatures:

1. The Nelson campaign’s main request was brushed aside as ludicrous. The judge immediately said he wouldn’t order all signature mismatch ballots automatically counted. This morning’s decision will be spun as a win by Nelson’s team, but anyone who can count realizes that’s not the case.
2. Leon County Supervisor of Elections testified that they were very liberal in how they matched signatures (even saying they’d count it as a match if they could match certain individual swoops) and that the ballots they threw out could not been seen as a match BY ANY REASONABLE PERSON.
3. The judge was clearly not pleased with the series of lawsuits Nelson and liberal DC groups have filed that ask him to rewrite the entire FL election code AFTER the election. Even with this morning’s limited decision (we’re confident will be overturned), it doesn’t bode well for the rest of the suits.

As we near the machine recount deadline this afternoon, it has become clear to everyone (except Bill Nelson) that Senator-elect Scott’s 12,000+ vote lead truly is “insurmountable.”

A few statements of note from a recent Politico story for your consideration:

  • “Nelson has two major problems, experts say: Nelson’s lawsuits were filed so late … and the margin he trails Scott by is so big… makes it highly unlikely that Nelson could make up enough ground.” 
  • “[Nelson] would have to win in every case. And even then, it would not seem to be enough to change the outcome.”
  • “It’s a rabbit out of a hat. But there’s not enough rabbit.”
  • “In the unlikely event Nelson can ‘run the table’ in court, he just can’t see how the Democrat could pull ahead. Where are the votes going to come from?”

And a bonus CNN article with a headline that can’t be missed: Bill Nelson needs a miracle in Florida. It likely won’t come.

It’s also become clear that Democrats will stop at nothing to count illegally cast ballots – because breaking or changing Florida election laws is the only way for them to get what they want, regardless of the will of the voters.

In fact, yesterday’s report from Politico detailed how the Democratic Party altered official state election documents to essentially encourage and instruct voters to try to vote days after the legal deadline… what appears to be part of a larger strategy of sowing discord and playing games with the legal process.

What remains unknown: Will Bill Nelson, a Senator with a 42-year career in politics and public service, choose to let his legacy be tarnished and replaced by the image of an angry, bitter career politician more focused on clinging to his seat in D.C. than on respecting the will of Florida voters? 

Governor Jeb Bush put it best: “Senator NELSON, please stop the lawsuits, let the votes be accounted according to Florida law and accept the results. Don’t tarnish your years of service to Florida.” 

At 3:00 PM today, it’s up to Nelson to decide.

Statement From Nelson Campaign Lead Recount Lawyer Marc Elias On Signature Mismatch Ruling

Recount Update: Day 4



As Bill Nelson’s high-priced Washington lawyers go to court today to argue against a process that they previously argued for (see 2016 ruling on curing absentee ballots), it’s worth noting that Marc Elias is currently making the exact opposite argument in a similar case in Arizona.

The culmination of their argument in Arizona is this: “Plaintiffs waited until after the election to bring suit, asking this Court to change the rules after the polls have closed and after eligible voters in certain counties, including Maricopa and Pima, already detrimentally relied on those counties’ policies. Because of their undue delay, the relief Plaintiffs seek – which would result in voter confusion and wrongful disenfranchisement – is barred by the doctrine of laches.” (page 7)

Hypocrisy, thy name is…

Meanwhile, Bill Nelson finally emerged from witness protection yesterday to read talking points prepared for him by Chuck Schumer (who looked over his shoulder and, presumably, pulled the strings). Let’s be honest about what’s going on here. Rick Scott won this race by a margin that is mathematically impossible to close in a recount.

They know they lost. They know that Rick Scott is the Senator-elect. They don’t care, because this isn’t about 2018 and this isn’t about Bill Nelson. This is about 2020. Chuck Schumer and his national Democrat comrades are working overtime to change Florida’s election laws so they can try to win a presidential election two years from now.

When the machine recount is complete on Thursday, Bill Nelson will have to decide if he wants to preserve his legacy and go out with dignity or if he wants to be forever remembered as the guy that liberal interest groups used in an effort to win the presidential election two years early.

“I think Bill Nelson and the Democrats are suing to throw out Florida’s election law because they think they need to get rid of the election laws to defeat President Trump in 2020. I think this is all about 2020.”

Despite the spin from Nelson lawyer Mark Elias and other Dems, there is a clear and stark difference between the lawsuits filed by the Scott for Florida team and those filed by Nelson and liberal groups…

Ours are filed to make sure that Florida law (which is designed to prevent voter fraud) is followed.

Theirs are filed with the goal of disregarding Florida law in an effort to count unlawful ballots.

Recount Update: Day 3

Senator-elect Rick Scott is gearing up for his first trip to Washington since winning the election for new-member orientation (including the photo and voting in leadership elections) with plans to get started on his mission of reforming D.C. and making it work for Florida families – not career politicians.

And speaking of career politicians, after a decades-long career and consistent claims of being an “independent voice,” Bill Nelson seems to have handed the reigns over to his D.C. lawyer.

After all, from desperate spin to laughable lawsuits, we’ve heard more from Mark Elias in the past three days than most Floridians have heard from Bill Nelson in years. But hey, whatever helps pile up those billable hours!

Which raises the question: where is Bill Nelson? What has his campaign been doing? You’ll notice, his campaign hasn’t been a party to any of the lawsuits filed by their side. They’re filed by the liberal groups controlled by Chuck Schumer and the only person speaking publicly is his DC lawyer Marc Elias. We’ve seen some proof of life videos from Bill Nelson, but other than that, we have no idea where he is. Do you?

During an interview on FOX News, Scott Advisor Brad Todd posed an important question for Bill Nelson…

“So what’s gonna happen on Thursday is this machine recount is gonna be complete. Bill Nelson’s gonna still be far behind and he’s gonna face a choice… His lawyer gets paid a lot, they get billed by the hour, they’d like to do this all winter but Bill Nelson has a legacy to think about. He’s been in politics since I was two-years-old. 

“He has to decide on Thursday, when he’s going to trail significantly, does he want his entire legacy to be painted as the guy who wouldn’t go away when he was voted out by the people of Florida?”

Nelson calls on Scott to recuse himself from recount

Orlando, Fla. – U.S. Sen. Bill Nelson today called on Gov. Rick Scott to recuse himself from “any role” in Florida’s recount process as the supervisors of elections across the state begin a mandatory machine recount of more than 8.2 million ballots cast in this year’s U.S. Senate race.

“[Rick Scott] should remove himself from any role in the recount process so the people can have confidence in the integrity of the election,” Nelson said in a video statement released today by his campaign. “Given his efforts to undermine the votes of Floridians, this is the only way that we can ensure that the people’s votes are protected. “

Nelson said Scott is “using his power as governor to try to undermine the voting process” and his recent actions make clear that he “cannot oversee this process in a fair and impartial way.”
“He’s thrown around words like voter fraud without any proof,” Nelson said. “He’s stood on the steps of the governor’s mansion and tried to use the Florida Department of Law Enforcement to investigate the Broward elections chief.

“He’s filed lawsuits to try to stop votes from being counted and to impound voting machines.”

As the recount in the Senate race continues, we should have a common goal; and that is to make sure that every lawful vote is counted and counted as the voter intended.

We must also allow this process to take place with civility in our discussions.

And that’s because there is a fundamental American principle at stake: protecting every citizen’s right to vote.

Now, two unfortunate facts have become clear as everyday folks are watching this process:
And one fact is that Rick Scott isn’t interested in making sure every lawful vote is counted. And the second is that he’s using his power as governor to try to undermine the voting process.

He’s thrown around words like “voter fraud” without any proof.

He’s stood on the steps of the governor’s mansion and tried to use the Florida Department of Law Enforcement to investigate the Broward elections chief.

He’s filed lawsuits to try to stop votes from being counted and to impound voting machines.

The reason he’s doing these things is obvious: he’s worried when all the votes are counted, he’ll lose the election.

Scott For Florida Files Additional Complaints Against Broward And Palm Beach Supervisors

Following the continued antics, failures and willful disregard of the law by Broward County Supervisor of Elections Brenda Snipes and Palm Beach County Supervisor of Elections Susan Bucher, the Scott for Florida team has filed emergency motions and complaints to protect the security of ballots and the ongoing recount process. These filings request that FDLE and the Sheriff’s Office be required to impound and secure all voting machines, tallying devices and ballots when they are not in use until the conclusion of the recount.

Considering Supervisor Snipes’ history of breaking the law by destroying ballots and Supervisor Bucher’s recent failure to follow legal requirements for reviewing ballots, these filings also request that both Supervisors be ordered to comply with all legal obligations and preserve all ballots and records connected with 2018 election.

Scott For Florida Announces Team Of Over 7,500 Volunteer Recount Representatives

Common Cause & League of Women Voters Call for Gov. Scott to Recuse Himself from Florida Recount

Today, Common Cause Florida and the League of Women Voters of Florida called on Gov. Rick Scott to immediately remove himself from any role in the recount of the 2018 Florida General Election.  The letter urges Gov. Scott to recognize the clear conflict of interest in overseeing the recount of his own race for the U.S. Senate and recuse himself from any related role or warns that the groups will be forced to immediately seek a formal emergency remedy from the courts.

Scott will recognize the inherent conflict of interest in overseeing the recount of his own race for the Senate and immediately take steps to remove himself from any role whatsoever in the process,” said Anjenys Gonzalez-Eilert, Executive Director, Common Cause Florida. “This should be an easy decision for Gov. Dear Governor Scott:

As one of the candidates for office who will be personally and directly impacted by the outcome of this year’s election, we the League of Women Voters of Florida and Common Cause Florida request that you immediately relinquish authority and remove yourself from any control of any person or agency responsible for the processing and counting of ballots from the November 6 general election.

Removing yourself will help to ensure that there is no appearance of any impropriety, undue influence or conflict of interest in directives being given to election officials.  The citizens of Florida have a right to fair and impartial governance of the election process and you have an obligation to ensure that there is no impropriety or appearance of impropriety.

You have intentionally politicized governance of the elections by publicly threatening a show of force — calling for the Florida Department of Law Enforcement, the state’s highest law enforcement agency, to investigate “rampant fraud” in South Florida when the FDLE and Department of State have indicated that there were no indications of fraud or criminal activity. And you angrily blamed your opposing political party for orchestrating an attempt to steal the election.

Just today you called on the state’s sheriffs to watch out for election violations and take action. These actions can easily be seen as intimidation of election officials who need to remain unencumbered while they engage in their very demanding work.

We request that you step back, release the reins of power and allow election officials to decide what tools of government should be employed to achieve the state’s paramount duty to fairly count each and every valid ballot. Florida’s officials must be permitted to conduct their official duties without further angry accusations or fear of retribution.

On behalf of every Florida voter, we ask that you to step away from taking any further role in supervising any official engaged in the process of ballot counting or election control. All valid votes must be counted and no governmental leader whose election hangs in the balance should ever take or threaten any action that could limit the value of any single vote or chill citizens’ desires to vote in our great state in the future.

Please issue a public statement that you will recuse yourself and remove yourself from any oversight of the 2018 election immediately or we will have no choice but to seek a formal emergency remedy from the courts.

Supervisor Snipes Fails To Comply With Court Order

Tonight, the Scott for Florida campaign received documents from the Broward County Supervisor of Elections. However,  Supervisor Snipes still fails to comply with today’s court order because she refuses to confirm whether or not additional ballots exist that must be counted.
Three days after Election Day, the vote tally continues to change and Supervisor Snipes still refuses to explain where and how the new votes came to light. The public deserves a clear and direct answer.

The Scott for Florida team is officially calling on Supervisor Snipes to formally confirm that she has now reported every last ballot in Broward County (excluding the yet-to-be-received military ballots and provisional ballots still pending canvassing certification). Failure to respond to this request would amount to a continued willful violation of the court’s order to provide all requested records and potentially subject the Supervisor to sanctions for contempt of court.

Governor Scott Wins Second Election Lawsuit

BROWARD COUNTY – Today, Broward County Circuit Judge Carol-Lisa Phillips ruled in favor of Governor Scott and ordered the immediate release of voter information from the county’s supervisor of elections.

This order is the result of the lawsuit filed by Rick Scott for Florida late yesterday in response to the Broward County Supervisor of Elections refusing to provide information to the public. Judge Carol-Lisa Phillips also found that Brenda Snipes violated Florida’s open records laws by failing to turn over the information. See the original filing HERE.

Nelson Statement on Counting of Ballots

ORLANDO, Fla. – U.S. Sen. Bill Nelson issued the following statement today:

Good afternoon.

This process is about one thing: making sure that every legal ballot is counted and protecting the right of every Floridian to participate in our democracy.

No one should stand in the way of the people of our state exercising their right to vote and to have their voice heard.

Clearly, Rick Scott is trying to stop all the votes from being counted and he’s impeding the democratic process. You can see this from his irresponsible, unethical and unprecedented press statement last night that he’s worried and he’s desperate.

The reason why he feels that way is obvious: we believe when every legal ballot is counted we’ll win this election.

A public office is a public trust — I won’t stand for anyone using his position to undermine our democratic process, and neither should the people of Florida. It’s wrong and it goes against every value that we have in our country.

Scott is abusing the full force of his public office as governor to stop a complete and accurate counting of all the votes in Florida – which would determine whether he wins or loses.

The governor has decided to abandon the most fundamental of all rights, because he fears that he will lose the election if all the votes are counted.

He isn’t telling the truth, which is: votes are not being found; they’re being counted.

We will continue to ensure that this election is conducted fairly, the rule of law is followed, and the democratic process is fulfilled.

Bill Nelson Hires D.C. Lawyer To Steal Election

This morning, Bill Nelson is introducing the people of Florida to Marc Elias, a hired gun from Washington, D.C. who will try to win an election for Nelson that Nelson has already lost.
Here is Nelson’s new lawyer’s explanation of his mission:“We’re doing this not just because it’s automatic, but we’re doing it to win.” 

In his own words, Nelson’s lawyer says this effort isn’t about making sure every vote counts or getting a fair count. No, for Bill Nelson- the task is getting the “win” …no matter what.
Let’s be clear: When Elias says “win,” he means “steal.”

It is sad and embarrassing that Bill Nelson would resort to these low tactics after the voters have clearly spoken. Maybe next, he’ll start ranting that Russians stole the election from him.
Nelson’s lawyer’s rap sheet includes another notablequote: “I have been involved in many recounts and there is no precedent for a recount changing the results of an election with the margins present in these states.”

“These states” = Michigan (10,704 margin), Wisconsin (22,748 margin) and Pennsylvania (44,292 margin).

Gov. Scott Statement On Election Results

TALLAHASSEE, Fla. – Today, Governor Rick Scott made a statement regarding election results. The Governor’s remarks as prepared for delivery are below. See the lawsuits that were filed in Palm Beach and Broward Counties today HERE and HERE.
 
“Late Tuesday night, our win was projected to be around 57,000 votes.
 
By Wednesday morning, that lead dropped to 38,000.
 
By Wednesday evening, it was around 30,000.
 
This morning, it was around 21,000.
 
Now, it is 15,000. 
 
On election night, Broward County said there were 634,000 votes cast.
 
At 1 am today, there were 695,700 ballots cast on election day.
 
At 2:30 pm today, the number was up to 707,223 ballots cast on election day.
 
And we just learned, that the number has increased to 712,840 ballots cast on election day.
 
In Palm Beach County, there are 15,000 new votes found since election night.
 
So – It has been over 48 hours since the polls closed and Broward and Palm Beach Counties are still finding and counting ballots – and the Supervisors – Brenda Snipes and Susan Bucher (BOOKER) – cannot seem to say how many ballots still exist or where these ballots came from, or where they have been.
 
The people of Florida deserve fairness and transparency and the supervisors are failing to give it to us.  
 
Every Floridian should be concerned there may be rampant fraud happening in Palm Beach and Broward Counties. And the Broward Supervisor of Elections Brenda Snipes has a history of acting in bad faith.
 
As you will recall, a judge ruled just this year that the office violated both state and federal laws by illegally destroying ballots in 2016.
 
In 2016, Brenda Snipes’ office posted election results half an hour before polls closed – a violation of election law. That same year, her office was sued for leaving amendments off of ballots.
 
In 2014, Brenda Snipes’ fellow democrats accused her of individual and systemic breakdowns that made it difficult for voters to cast regular ballots.
 
All Floridians should be concerned about that.
 
Palm Beach County is also refusing to provide information to the public. And they are illegally refusing to allow official party representatives into the ballot counting area and forcing people to stand behind a glass wall with limited visibility and no ability to hear what is going on.
 
This is a clear violation of Florida law – and we have just filed a lawsuit.
 
Both Broward and Palm Beach Counties have failed in their duty to follow Florida law which requires that vote by mail and absentee ballots are accounted within 30 minutes of polls closing. Further, Palm Beach County has failed to update the Department of State since 10:19 am yesterday. This is in complete violation of Florida law which requires updated reports every 45 minutes until results are completely reported.
 
We’ve all seen the incompetence and irregularities in vote tabulations in Broward and Palm Beach for years. Well…here we are again.
 
I will not sit idly by while unethical liberals try to steal this election from the people of Florida. 

Senator Nelson hired one of Hillary Clinton’s lawyers from D.C., and the first thing he did was tell reporters that he is here to win the election. He did not say that he wants a full and fair election or even an accurate vote count. Here are some other things he has said.
 
In 2010: When his democratic client in Minnesota was leading by 8,000 votes, he said the lead was ‘insurmountable.’
 
In 2014: When his democratic client in Virginia was leading by 12,000 votes, he said there was ‘no precedent’ for a successful recount. He also said that recounts ‘really only happen where you are talking about dozens or a few hundred votes separating the candidates.’
 
In 2013: When another one of his democratic clients in Virginia was leading by only 165 votes, he said that recounts ‘do not tend to change the results.’
 
In 2016: When his democratic client in North Carolina was leading by 10,000 votes, he called it a ‘close but significant margin’ that would be ‘insurmountable.’ He also called on the opponent to ‘graciously concede’ rather than waste taxpayer money on a deficit that could not be overcome.
 
Again in 2016: When his client Hillary Clinton had lost the presidential race, he wrote an article highlighting that the margin of 10,704 votes in Michigan quote ‘well exceeds the largest margin ever overcome in a recount.’
 
Now, he is here to try to steal the election, and to try to thwart the will of the voters of Florida.
 
Every day since the election, the leftwing activists in Broward county have been coming up with more and more ballots out of nowhere.  We all know what is going on.  Every person in Florida knows exactly what is happening. Their goal is to keep mysteriously finding more votes until the elections turn out the way they want.

And when that fails, they will file a bunch of lawsuits in order to try to overturn the will of the voters.

There are 67 counties in Florida, only these two counties are involved in these shenanigans. There are NO OTHER COUNTIES – REPUBLICAN OR DEMOCRAT- that are trying to steal this election, or who are still finding ballots. 
 
Some believe that this is simply rank incompetence. THAT IS CLEARLY TRUE.
 
BUT it would also be naïve to not realize that they could be trying to overrule the will of the voters of Florida.
 
Tonight, I am asking the Florida Department of Law Enforcement to investigate this immediately and I am considering every single legal option available.  
 
No rag tag group of liberal activists or lawyers from D.C. will be allowed to steal this election from the voters in the state of Florida.
 
I am proud to be the next Senator from the State of Florida and look forward to going up there and making Washington work for all Americans.”

The Florida Election should be called in favor of Rick Scott and Ron DeSantis in that large numbers of new ballots showed up out of nowhere, and many ballots are missing or forged. An honest vote count is no longer possible-ballots massively infected. Must go with Election Night!

In the 2016 Election I was winning by so much in Florida that Broward County, which was very late with vote tabulation and probably getting ready to do a “number,” couldn’t do it because not enough people live in Broward for them to falsify a victory!
